Why You Need a Website Privacy Policy

A privacy policy is one of the most important disclosure statements that your website can have. Its purpose is to inform visitors to your website of your company’s policy around the collection, storage and use of private information. A major concern for many website visitors is 'how is my personal information going to be used? Personally identifiable information includes, but is not limited to; name, address, telephone number, email address, date of birth and financial information.

The ultimate goal of a privacy policy is to protect the consumer from the misuse of this private information. As a company you must be aware though that simply displaying a privacy policy on your website is of little use if the policy is not adhered to within the company’s practices. Mis-managing the information that you collect can expose your company to significant liability.

Consideration must also be given to the language used within your privacy policy. There is a real danger in simply copying the policies found on other websites if the practices contained within these policies do not accurately reflect your own company's practices. The best option is to seek independent advice from a firm familiar with the laws relating to data collection. They'll spend time to understand exactly how your company collects, stores and uses information (both online and offline) so that an accurate policy can be drafted for use on your website.

Although we do recommend that our clients supply their own privacy policy, we have also developed a generic privacy policy that we can apply to our client's websites. We provide this wording as a guide to the type of issues that may need to be addressed in your privacy policy but make no claim as to the suitability of the wording to your particular organisation.  We strongly recommend that you use it as a starting point and edit the wording to suit your company's practices.
